Dear Ms. Vaughn,
On November 2, 2018, I wrote to you stating that the Company has no basis in law, our collective bargaining agreement, or the Company’s drug and alcohol testing policy for implementation of its program of drug testing of Fleet Service employees, which American purportedly justifies by citing American’s contract with the USPS. I further stated that the drug testing of Fleet Service employees generally constituted a unilateral change of the CBA; and that drug testing of Fleet Service employees without compliance with Article 29 of the CBA or American’s own drug testing policies and procedures also constituted a unilateral change of the CBA. My letter called on American to cease its program of drug testing Fleet Service employees.
Because American has not ceased its program, or indicated that it would do so, TWU filed a complaint in the United States District Court for the Northern District of Illinois on Friday November 16, 2018 that asserts that American has violated the Railway Labor Act by implementing its program for drug testing Fleet Service employees. A copy of TWU’s complaint is being provided to you with this letter.
